Who we are and what this page covers

Saint-Tropez Lux Yachts is the trading brand under which the website lacompagnie-a.com is operated, offering crewed day charters and longer charters on a curated fleet of 41 motor yachts, sailing yachts and day-boats, with day rates from €1,700. Our vessels are berthed directly in the Vieux Port and Port de Saint-Tropez, allowing same-day embarkation and priority access to the most sought-after anchorages along the Gulf, from Pampelonne Beach to the quieter shores of Cap Taillat. These terms apply to all bookings made through the website, by email, by phone or by WhatsApp, and they form part of the contract between the client and Saint-Tropez Lux Yachts once a booking is confirmed in writing. Any question about these terms or about a booking can be sent to [email protected].

How an enquiry becomes a confirmed booking

No charter is booked or paid for directly online. A visitor sends an enquiry through the website form, by email, by phone or by WhatsApp, indicating the chosen yacht if known, the charter start and end dates and the number of guests. Our team reviews the request and replies with a written quote setting out the vessel, the dates, the price and what is included. The booking is only confirmed once the client accepts that quote in writing and the deposit described below is received; until that point, no yacht is held and no price is guaranteed.

Prices and what is included

The price stated in the written quote is the price of the charter itself, including the vessel, its licensed crew and the hours or days agreed. It does not include fuel, marina fees, the advance provisioning allowance (APA) that applies to larger yachts, catering or any extras such as water sports equipment, special requests or additional crew, which are charged separately exactly as set out in the written quote. Nothing is added to the final invoice that was not described in that quote.

Payment and deposit

A booking is confirmed once a deposit equal to 50% of the charter price has been received. The remaining balance is due 7 days before the departure date. Payment instructions are provided in the written quote; bookings are not processed or settled through the website itself.

Your right of withdrawal under EU consumer law

Charter bookings are made for a specific date or period of embarkation, which places them within the category of leisure services supplied on a specific date, as described in Article 16(l) of Directive 2011/83/EU on consumer rights and, in France, in Article L221-28 of the Consumer Code. This means that the usual 14-day right of withdrawal available for most distance contracts does not apply to a yacht charter booking. In its place, Saint-Tropez Lux Yachts offers the voluntary cancellation policy set out in this document, which allows a full refund when cancellation is requested more than 14 days before departure and partial protection closer to the departure date, as described below.

Cancellation and changes requested by the client

If the client cancels more than 14 days before the departure date, the deposit and any balance already paid are refunded in full. If cancellation is requested between 7 and 14 days before departure, 50% of the amount paid is refunded. If cancellation is requested less than 7 days before departure, no refund is made. A change of date is offered free of charge, once, provided it is requested more than 7 days before departure and the new date is available on the chosen vessel; a second date change, or a request made within 7 days of departure, is treated as a cancellation under the tiers above unless we agree otherwise in writing.

Cancellation or changes made by us

Safety on the water comes before the schedule. If the captain or the relevant port authority considers conditions unsafe for departure, whether due to weather, sea state, a technical issue affecting the vessel, or any other event beyond our control, the client is offered a straightforward choice: a free new date for the charter, or a full refund of all sums paid. This same choice applies where a charter cannot proceed because of force majeure. The captain's assessment of safety is final and is not open to negotiation, since it is made solely to protect guests and crew.

Guest capacity and safety on board

The number of guests on any charter may never exceed the licensed capacity of the vessel stated in the booking confirmation. This limit exists for the safety of everyone on board and is set by the vessel's own certification, not by us. The crew is entitled to refuse boarding, or to require someone to leave the vessel, if that person's behaviour or condition endangers the safety of guests, crew or the yacht itself.

The captain's authority and itinerary changes

The captain commands the vessel at all times and has final authority over all matters of navigation, safety and seamanship, including the decision to alter, shorten or cancel part of a planned itinerary. While every effort is made to follow the route agreed with the client, including access to anchorages such as Pampelonne Beach or Cap Taillat, the captain may adjust the itinerary in response to weather, sea conditions, port instructions or any other circumstance affecting the safety or proper conduct of the charter. Such adjustments do not constitute a breach of the booking.

Conduct on board, damage and personal belongings

Guests are expected to follow the crew's instructions at all times, particularly those concerning safety equipment, swimming, water sports and movement on deck. The client is responsible for damage caused to the vessel, its equipment or its tender by the deliberate or negligent act of any guest, and the cost of repair may be charged in addition to the charter price. Saint-Tropez Lux Yachts does not accept responsibility for personal belongings brought on board, and guests are encouraged to keep valuables with them and to take their own precautions against loss or damage.

Liability limits and complaints

Saint-Tropez Lux Yachts' liability in connection with a charter is limited to the charter price actually paid for that booking, except in cases of death or personal injury caused by our proven negligence, for which liability is not limited by this clause. We are not liable for indirect losses, such as missed connections, lost enjoyment or costs incurred independently of the charter itself. Any complaint about a charter should be sent to [email protected] with the booking details and a description of the issue; we review every complaint and respond in writing within a reasonable time.

Use of the website, governing law and changes to these terms

The content of lacompagnie-a.com, including yacht descriptions, photographs and pricing information, is provided to help visitors choose and enquire about a charter, and is not to be copied or reused for other commercial purposes without our agreement. Prices and availability shown on the site are indicative and are only confirmed in the written quote. These terms and any booking made under them are governed by French law. Any dispute that cannot be resolved amicably, including by contacting [email protected], is submitted to the competent courts in France for the place where the charter is performed, in Saint-Tropez. We may update these terms from time to time to reflect changes in our services; the version published on the website at the time a booking is confirmed is the one that applies to that booking.
